“SAKHHE SHEJARI” CALL FOR ENTRIES TERMS AND CONDITIONS
The following are the terms and conditions governing the “Sakhhe Shejari” Call for Entries (“Entry Process”) which is pertaining to the program “Sakhhe Shejari” (“Program”) by Viacom18 Media Private Limited (“Viacom18”) that will be telecasted on Colors Marathi (“Channel”) from 11th Jan 2021 at 18:30 hours.
By participating it is deemed that the participating family(ies) (including all participating family members and family members of participating neighbour) have read, understood, accepted and agreed to unconditionally abide with all the Terms and Conditions of the Entry Process.
(A) Procedure to register to participate in the Entry Process:
1. The Entry Process will be open from January 11, 2021 at 18:30 hours to December 15, 2021 at 12:00 hours or until such time as may be communicated by the Channel (“Period”). Viacom18 /Channel shall extend or curtail the Period or abandon the Entry Process at its sole discretion without any further notice.
2. The participating family(ies), who are interested in participating and qualifying for the Entry Process, should send the entry through WhatsApp application to 8406840601. The message should contain the following details – name, age, profession, number of family members, residential address of sender’s entire immediate family members and your neighbour’s immediate family members who intend and agreed to be part of the Entry Process and strengths of both the families to participate in the Entry Process and / or Program. The participating family(ies) will then receive a push back message acknowledging their entries, however, the same shall not be construed as acceptance of your entry in the Entry Process and / or Program. For the purpose of the Entry Process, the participating family(ies) shall mean and include sender’s immediate family and immediate family of your neighbour whose details will be provided to us on the number given above. By sending the entry, the sender of the entry from the participating family(ies) represents and warrants that he / she has obtained requisite consent from all family members of the participating family(ies) and family members of the neighbour family to send the details, including personally identifiable information, through the message and to participate in the Entry Process and / or the Program.
3. The participant family(ies) must be citizen and resident of India and must speak and understand Marathi language fluently, and of eighteen (18) years of age or above [except kids of the participating family(ies) which must be above the age of 12 (twelve) at the time of sending the entry, however kid(s) shall always be accompanied and represented by natural or legal guardian of the participating family(ies)]. Any of the participant family(ies) member should not have criminal conviction or an arrangement or a contract that prevents the participating family(ies) from participating in the Entry Process.
4. The participating family(ies) needs to use a valid phone number, registered either with the network operators viz. Aircel, Airtel, Idea, Reliance Jio, Tata, Vodafone. Usage of internet shall be chargeable at the applicable data charges of the network operators as on date of upload of the rules and regulation, and any change in the charge (due to law or network operator’s policy) shall be checked by the viewer / sender at his/her sole responsibility. It is to note that Viacom18 / Channel does not charge any fee or cost on the participating family(ies) / the Selected Participating Family(ies) for the purpose of the Entry Process and / or for the Program.
5. Viacom18 shall not be responsible in case of any network problems such as breakdown of machinery, unclear network, disruption in the network and/or the cost of the SMS or message charged by the network operator. Any dispute in connection to the same shall be settled between the participating family(ies) / Selected Participating Family(ies) and the network operator without involving Viacom18.
6. In case of telecom and/or network failure, Viacom18 reserves the right to change the entry mechanism or take such necessary steps as it may deem fit.
7. All the entries should state all the required information, which have been asked from them by the Channel / Viacom18 and / or authorized representative.
8. Any entry sent to the abovementioned mobile number after the Period mentioned herein shall not be considered and shall be null and void. The abovementioned mobile number will be deactivated at the completion of and / or any time prior to the Period and no entry shall be entertained thereafter.
(B) Shortlisting Process:
1. Once the complete entry is received by the Channel/Viacom18 during the Period, the Channel, itself and / or through its authorized representatives shall connect with the participating family(ies) to verify the details and to shortlist the participating family(ies) for the purpose of the Program on the scrutiny criteria as solely determined by Viacom18.
2. The participating family(ies) are required to remain available on the scheduled date at the time communicated by the Viacom18. If the participating family(ies) fail to remain available on the scheduled date and time, such participating family(ies) will be disqualified and no rescheduling request will be entertained by the Viacom18.
3. The participating family(ies) will be required to get themselves registered by executing the necessary documents and also by furnishing the documents as required to verify the personal details provided by the participating family(ies). Each of the participating family(ies) shall be required to furnish the necessary documentation (as stated in the General Rules and / or intimated by the Viacom18 / Channel) in original to confirm the eligibility details, etc. provided by the said participating family(ies). In case the said participating family(ies) is unable to furnish the original document(s) to verify the eligibility details and also submit photocopy of the same, the said participating family(ies) shall be disqualified by the Channel/Viacom18.
4. Viacom18 shall select such number of participating family(ies) as may be decided by Viacom18 at its sole discretion for the purpose of the Program (“Selected Participating Family(ies)”). Viacom18 shall solely have the right to select the Selected Participating Family(ies) and none of the participating family(ies) shall dispute and/or be entitled to dispute the decision made by Viacom18.
5. Viacom18 reserves the right to select the Selected Participating Family(ies) the same shall be informed/contacted by Viacom18.
6. The participating family(ies) / Selected Participating Family(ies) shall not raise any dispute with regard to the Entry Process including but not limited to the selection of the Participating Family(ies) etc.
7. Non-conformance by the Participating Family(ies) to any and all the Terms and Conditions herein or as set by Viacom18 from time to time will make such Participating Family(ies)’s Entry(ies) null and void.
8. The Selected Participating Family(ies) shall have to procure / obtain necessary approval from its respective housing society and / or concerned authorities for shooting in their housing society premises for the purpose of the Entry Process and / or the Program.
(C) Rules for participating in the Program:
1. Viacom18 and/or the Channel(s) shall have the sole right to decide the dates of shoot of the Program and the Selected Participating Family(ies) shall be present on all such days as communicated by the Channel and/or Viacom18 from time to time.
2. In the event, the Selected Participating Family(ies) is unavailable on the date on which Viacom8 has decided to shoot the Program, such Selected Participating Family(ies) shall be disqualified.
3. The Selected Participating Family(ies) will have to participate in normal / usual family game(s) including but not limited to games playable with plastic balls, paper planes, balloons, blindfold etc., as determined by Viacom18 / Channel /authorized representative of the Channel / Viacom18, with each other individually or in a group of 2 or more members or entire family with the neighbouring family, as determined or instructed by Viacom18 / Channel / authorized representative of the Channel / Viacom18, on the date(s) of the shoot as intimated by Viacom18 / Channel as per the above mentioned points. However, the Channel / Viacom18 do not entertain any game which test the physical endurance of any member of the Selected Participating Family(ies) and the members are advised not to engage in any such physical activity during the game and / or shoot for the Entry Process and / or for the Program.
4. All and any incidental costs (direct and/or indirect), in relation to the Entry Process, including but not limited to any STD/ISD/local calls including travel shall be borne by the Selected Participating Family(ies) and in no manner whatsoever shall the Viacom18 be held responsible for the same.
5. The Selected Participating Family(ies) shall not at any point of time be entitled to and/or claim any amount for the performance in the Program.
6. Viacom18 and/or the Channel reserve the right to at any time to withdraw the Entry Process without giving any prior notice thereof.
Gratification Details:
The Selected Participating Family(ies) shall stand a chance to get a personalized name-plate and / or the Selected Participating Family(ies) which may be declared as winner in various rounds of game(s) as mentioned in point 3 under the head (C), including but not limited to question & answer, family activity task and any other round / family game as decided by Viacom18, of the particular episode of the Program by the Channel shall stand a chance to win a cash prize aggregating to Rupees 2500/- (Two thousand fine hundred only).
General Rules
1. The participating family(ies) / Participating Family(ies) / Selected Participating Family(ies) should be citizens and residents of India, must speak and understand Marathi language fluently, and of eighteen (18) years of age or above [except kids of the participating family(ies) which must be above the age of 12 (twelve) at the time of sending the entry, however kid(s) shall always be accompanied and represented by natural or legal guardian of the participating family(ies)] to qualify for the Entry Process.
2. Proof of age is a must for the participating family(ies) / Participating Family(ies) / Selected Participating Family(ies), must be submitted to the Channel/ Viacom (i.e., Birth Certificate, 10th Class leaving Certificate/ School certificate/ passport/ an affidavit signed by a magistrate).
3. The participating family(ies) / Selected Participating Family(ies) shall have to procure / obtain necessary approval from its respective housing society and / or concerned authorities for shooting in their housing society premises / compound / surroundings for the purpose of the Entry Process and / or the Program.
4. The participating family(ies) / Selected Participating Family(ies) represent and warrant that it has obtained all necessary consents and approvals from all the participating members of both the families and to share the personally identifiable details of both the families to Viacom18 / the Channel / any authorized representative(s) of Viacom18 / the Channel for the purpose of the Entry Process and / or the Program. Viacom18 / the Channel / any authorized representative(s) of Viacom18 / the Channel shall have right to send or receive any communication (promotional or transactional) to the participating family(ies) / Selected Participating Family(ies) for the purpose of the Entry Process and / or the Program.
5. Viacom and/or the Channel reserve all rights to make amendments to the existing Terms and Conditions or withdraw the Entry Process without giving prior notice. It shall be the sole responsibility of the participating family(ies) to check the Terms and Conditions of the Entry Process on the website of Viacom18 i.e. www.colorsmarathi.com.
6. Non-conformance by any participating family(ies) / Selected Participating Family(ies) of the rules of the Entry Process will disqualify the participating family(ies) / Selected Participating Family(ies) from participation immediately, as the case may be.
7. Viacom18 may in its sole discretion exclude a participating family(ies) / Selected Participating Family(ies) from participation in the Entry Process and/or Program which may include without limitation (i) circumstances which, in Viacom18’s view, renders the participating family(ies) / Selected Participating Family(ies) unfit, medically or otherwise, to participate therein; (ii) inability to produce documentation required by Viacom18 and/or the Channel in the rules and/or at any given point of the time.
8. Viacom18 reserves the right to cancel the entry of the participating family(ies) / Selected Participating Family(ies) for any reason whatsoever. For avoidance of doubt, the participating family(ies) / Selected Participating Family(ies) agrees that all the intellectual property rights in and to the Entry Process shall continue to vest with Viacom18 for whole world and in perpetuity, without any consideration payable to the participating family(ies) / Selected Participating Family(ies).
9. Viacom18 and/or the Channel may refuse the participating family(ies) / Selected Participating Family(ies) from participating in the Entry Process in the event of his/her fraud, dishonesty or non-entitlement to participate in the Entry Process and / or any medical grounds and / or non-submission of relevant approvals or permissions under this Terms and Conditions.
10. All participating family(ies) / Selected Participating Family(ies) of the Entry Process agrees that he shall make himself available from time to time and co-operate with the Channel and/or Viacom18 and participate in any activity and/or campaign (“Promotional Activity”) of any nature whatsoever without any money payable to the participating family(ies) / Selected Participating Family(ies). Further, neither the participating family(ies) nor the Selected Participating Family(ies) shall at any point of time refuse or disagree to participate in any such Promotional Activity or the Program (as the case may be) for any reason whatsoever. The participating family(ies) / Selected Participating Family(ies) agree that the footage of any nature with regard to the participating family(ies) / Selected Participating Family(ies) shall vest with Viacom18 , including but not limited to all intellectual property rights and any other rights for whole world and in perpetuity.
11. The Participating family(ies) / Selected Participating Family(ies) agrees that the Entry Process is only an opportunity to participate in the Program and hence it cannot be exchanged with other items and/or for cash equivalent. If the Participating family(ies) / Selected Participating Family(ies) refuse to accept the Selection, the Channel and/or Viacom18 shall be released from all obligations towards the Participating family(ies) / Selected Participating Family(ies).
12. Viacom18 and/or the Channel shall have irrevocably rights to the Entry Process and/or participation of the participating family(ies) / Selected Participating Family(ies) including all the activities of the participating family(ies) / Selected Participating Family(ies) during their participation in the Entry Process including but not limited to the participating family(ies) / Selected Participating Family(ies) being filmed and/or recorded and/or broadcast on the Channel or any other channel that Viacom18 and/or any other channel, which Viacom18 and/or the Channel may deem fit. Further, the participating family(ies) / Selected Participating Family(ies) shall permit Viacom18 and/or Channel to use of the participating family(ies) / Selected Participating Family(ies)’s name, likeness and private life to be included in the subject matter of the Entry Process and any related publicity, advertising, magazine material and/or otherwise. Further Viacom18 and/or Channel shall have full right to the footage of any nature in relation to this Entry Process and all such rights shall at all times vest with Viacom18, including but not limited to all intellectual property rights, copyrights and any other rights, in any and all media, for whole world and in perpetuity. It can be arranged, re-arranged, added to other material without any payments to the participating family(ies) / Selected Participating Family(ies).
13. Notwithstanding a participating family(ies) / Selected Participating Family(ies)’s participation in the Entry Process and/or the Program (as the case may be) there is no obligation on the part of Viacom18 to broadcast the Entry Process and/or the Program in which he / she has taken part, or any or all of his contribution as recorded by Viacom18, and it shall be at the sole discretion of the Channel / Viacom18.
14. The participating family(ies) / Selected Participating Family(ies) agrees that he / she shall hold harmless the Channel, Viacom18, its employees, officers or any other person in relation to any mental or physical or psychological injury/damage/harm/loss suffered by him / her, in any manner, whatsoever in connection with the Entry Process and/or the Program and waives all rights to file in person/ through any family member and/or third party any applications, criminal and/or civil proceedings in any courts or forum in India against the Channel and/or Viacom18 to claim any damages or relief or otherwise.
15. Employees of the Channel and/or Viacom18 and/or the sponsor of the Program (if any) and the members of their immediate family, persons with criminal convictions, persons other than citizen and residents of India who can speak and understand Marathi language fluently, are ineligible to enter the Entry Process.
16. Participation of the participating family(ies) / Selected Participating Family(ies) in the Entry Process shall be construed that the participating family(ies) / Selected Participating Family(ies) has waived their rights to dispute any decision(s) made by Viacom18 and/or the Channel in connection to the Entry Process and that the participating family(ies) / Selected Participating Family(ies) agrees to all the decision(s) made by Viacom18 and/or the Channel and that all the decision shall be final and binding upon the participating family(ies) / Selected Participating Family(ies). No correspondence in this regard shall be entertained.
17. The participation of the participating family(ies) / Selected Participating Family(ies) in the Entry Process shall mean that the participating family(ies) / Selected Participating Family(ies) has read, understood, accepted and agreed to abide with all the rules including the general rules of the Entry Process.
18. Viacom18 may at its sole discretion extend or curtail the Period of the Contest or may suspend or abandon the same at any time without any prior notice of the same.
19. Entries sent after the Period will not be considered for the Entry Process and shall be deemed null and void.
20. Participating Family(ies) shall at all times ensure that they adheres to the applicable laws in force in the territory of India, and any & all guidelines, rules, regulations, notifications relating to COVID-19 as issued by the relevant government, at national / state / municipal level, and issued by the relevant housing society. The Participating Family(ies) undertakes and represents that he / she is medically fit to participate in the Entry Process and / or Program and that the participation in the Entry Process / Program will be subject to the results of the Participating Family(ies) Covid-19 test being negative. Further, if required by Viacom18 the Participating Family(ies) will also submit fitness or declaration form informing about the health status and exposure to Covid-19 prior to or during the Entry Process and / or the Program.
19. Participating family(ies) / Selected Participating Family(ies) must enter the Entry Process on his/her own family and with free and informed consent of neighbour’s family, and Entry(ies) by proxies will not be accepted. In the event that it is found that a Participating family(ies) / Selected Participating Family(ies) has submitted Entries in violation of this term, Viacom18 reserves the right to disqualify such Participating family(ies) / Selected Participating Family(ies) from the Entry Process.
20. Each Entry shall be checked by Viacom18 inter alia, if the answer given is correct, and follows the aforementioned rules. The decision of Viacom18 shall be final and binding. The Participating family(ies) / Selected Participating Family(ies) agrees and confirms that the Participating family(ies) / Selected Participating Family(ies) shall at no time challenge such decision of Viacom18and/or raise any claims or disputes in relation to the same.
21. Viacom18 shall not be responsible in the event entries are not received due to any technical error of any nature whatsoever. For purposes of the Terms and Conditions, “receipt” of an entry occurs when the entry reaches the WhatsApp number designated for the Entry Process. Any automated receipt confirmation does not constitute proof of actual receipt. Any unclear/incorrect/incomplete entry, including wrong characters in entry shall be considered invalid and deemed null and void.
22. The Participating family(ies) / Selected Participating Family(ies) agree and confirm that Viacom18 shall at no time be held responsible and/or liable for any non-receipt of an entry due to a technical error and/or defect in the functioning of the telecom server/WhatsApp Application, and to the extent permissible in law, the Participating family(ies) / Selected Participating Family(ies) waives his/ her right to initiate any claim, proceedings, actions, damages, suits, in relation to the same against Viacom18. Neither Viacom18 nor the Channel shall be responsible in case of any kind of network problem, technical failure whatsoever and/or the data charges/costs charged by the network operator(s). Any dispute in connection to the same should be settled directly between the viewer/subscriber and the operator(s) without involving Viacom18 and/or the Channel in any manner.
23. Viacom18 shall not be responsible or liable for any technical disruption and/or failure and/ or any other difficulties of such nature, due to which the participating family(ies) / Selected Participating Family(ies) is un-reachable or any technical disruption and/or failure/ and/ or any other difficulties of such nature, due to which Viacom18 is unable to intimate the participating family(ies) / Selected Participating Family(ies).
24. Viacom18 reserves the right to disqualify any Participating family(ies) / Selected Participating Family(ies) from participating in the Contest if the Participating family(ies) / Selected Participating Family(ies) are found to be in breach of any provisions of these Terms and Conditions or as revised from time to time. The decision of Viacom18 in this regard shall be final and binding upon the Participating family(ies) / Selected Participating Family(ies), and the Participant shall not at any time challenge and/or dispute such decision of Viacom18.
25. The Selected Participating Family(ies) agrees and confirms that the gratification so awarded to winner(s) by Viacom18 shall be the sole gratification/ prize, and that the Selected Participating Family(ies) shall not be entitled to any further gratification at any time.
26. The gratification is non-transferrable and non-exchangeable. For the purpose of clarity, no cash equivalent or alternative prize will be given to the Selected Participating Family(ies) and the Selected Participating Family(ies) cannot exchange the gratification for a gift of similar value.
27. The image of the gratification depicted on the press ads / posters / TVCs etc. are for illustrative purposes only and the actual gratification may vary from the depiction made and, on the size, and weight of the gratification.
28. During the acceptance/delivery of the gratification if any loss/damage etc. is caused/incurred, Viacom18 shall not be liable for any such loss/damage etc. Further, Viacom18 shall not be responsible or liable for any change in the gratification.
29. The Selected Participating Family(ies) agrees that he/she shall not hold Viacom18 and/or its employees, responsible for delays or any problem in connection to the gratification.
30. Neither Viacom18 nor its employees have given a guarantee and/or warranty regarding quality, brand, value, of the gratification and the Selected Participating Family(ies) agree not to hold Viacom18and its employees, responsible with regards thereof. It is clarified that Viacom18 shall not be responsible for the quality, value etc. in connection to the gratification and the supplier shall be solely responsible for the same.
31. In the event of unforeseen circumstances beyond the control of Viacom18, and the gratification not being made available to the Selected Participating Family(ies), or the said Entry Process/ gratification being cancelled / re-scheduled / suspended etc., the Selected Participating Family(ies) shall not have the right to claim any damages or monies from Viacom18 and by participating in this Entry Process, the Selected Participating Family(ies) waive their right to make any such claims against Viacom18.
32. Viacom18 shall not be responsible for the quality or deficiency etc. of the gratification and no claim or request, whatsoever, in this respect shall be entertained by Viacom18.
33. The Participant agrees that the gratification will be provided to and will be accepted by the Participants on an ‘as is’ basis and the Participants shall not raise any objection /claims of any nature whatsoever against Viacom18 at anytime in event of any damage caused to the product (being provided as gratification), while in transit and/or in event the product provided as gratification is defective in any manner and/or otherwise. The Participant shall not claim any refund with respect to the gratification in event of any damage/ defect. The Participant agrees and acknowledges that Viacom18 shall not be responsible and/or liable for the quality / condition/utility / usability, etc. of the products provided as gratification. The gratification shall be provided only after verifying the credentials of the winning Participants as required by Viacom18 and the process of providing / distributing the gratification shall be commenced only after the entire completion of the Entry Process. Gratification shall be non-exchangeable, non–cashable, non–negotiable, non-transferable and no communication shall be entertained by Viacom18 in this regard.
34. The Winner and / or the Selected Participating Family(ies) agree that if due to any reason, whatsoever, beyond the control of Viacom18 the gratification and/or anything in connection to the gratification and/or the enjoyment of the gratification becomes ineffective or invalid, Viacom18 cannot be held responsible and/or liable for the same.
35. All and any incidental costs direct and/or indirect, applicable taxes, in relation to the gratification and / or participation in the Entry Process and the Program, shall be borne by the Selected Participating Famliy(ies) and in no manner whatsoever shall Viacom18, be responsible or liable for the same in any manner whatsoever.
36. Viacom18 is in no manner whatsoever responsible and/or shall not be held liable in any manner whatsoever, for any injury, death, mental trauma, health or medical issue caused to the Participating family(ies) / Selected Participating Family(ies) in any manner whatsoever or for any reason whatsoever in connection to the Entry Process, Program and/or gratification.
37. Viacom18 reserves the right to forfeit the gratification in the event it is found by Viacom18 that any information provided by the Participating family(ies) / Selected Participating Family(ies) is wrong, fraudulent or any misrepresentation is made by the Participating family(ies) / Selected Participating Family(ies).
38. The Participating Family(ies) / Selected Participating Family(ies) shall do any and all acts and execute any and all documents in such manner and at such location as may be required by Viacom18 in its sole and absolute discretion to protect, perfect or enforce any of the rights granted or confirmed to Viacom18.
39. Each participating family(ies) / Selected Participating Family(ies) consents to the use of information supplied by the Participating family(ies) / Selected Participating Family(ies) for the purposes as set out in these Terms and Conditions and / or Entry Process and/ or the Program. The Participating family(ies) / Selected Participating Family(ies) agrees and confirms that such contact details shall be their own, and the Participating family(ies) / Selected Participating Family(ies) shall at no time submit any contact details which belong to a third party. Viacom18 and the Channel shall not be liable in any manner to any such third party in case the participating family(ies) and / or the Selected Participating Family(ies) provides details, including personally identifiable information, of any such third party.
40. The Participating family(ies) / Selected Participating Family(ies) shall fully indemnify, defend and hold harmless, Viacom18 its affiliates, officers, directors, employees and agents (collectively the “Indemnified Persons”) from and against any and all losses, claims, actions, damages, liabilities, penalties, costs and expenses, (including without limitation reasonable attorneys’ fees and court fees) (collectively “Losses”), that the Indemnified Person may incur or suffer or likely to incur or suffer as a result of or arising out any (i) breach of any terms and conditions hereunder; (ii) willful misconduct or negligent acts or omissions; (iii) any claims by any third party for any losses, damages, costs, expenses, injuries suffered by such third party, arising out of or in relation to the Participating family(ies) / Selected Participating Family(ies) during the Entry Process and/or enjoyment of the gratification and / or the Program.
41. The participating family(ies) / Selected Participating Family(ies) grant Viacom18 and / or the Channel irrevocable consent in perpetuity to the use his/ her name, photographs, video tape taken during the Entry Process in connection with the Program, in any and all applications including but not limited to advertising, commercials, promotion, stories, text, articles and commercial exploitation, in any and all media forms, including but not limited to radio, broadcast and television, newspapers and magazines at any time without the Participants further knowledge or consent.
42. The participating family(ies) / the Selected Participating Family(ies) agrees that he/she shall make himself/herself available from time to time and co-operate with Viacom18 and participate in any activity and/or campaign (“Promotional Activity”) of any nature whatsoever without any money payable to the Short Listed / Selected Participating Family(ies). Further, the Short Listed / Selected Participating Family(ies) shall at no point of time refuse or disagree to participate in any such Promotional Activity for any reason whatsoever. The Short Listed / Selected Participating Family(ies) agrees that the footage of any nature with regard to the Short Listed / Selected Participating Family(ies) shall vest with Viacom18, including but not limited to all intellectual property rights and any other rights for worldwide and in perpetuity.
43. By participating in the Entry Process and / or the Program, it shall be construed that the participating family(ies) / Selected Participating Family(ies) has waived his/her right to raise any dispute with regard to the Entry Process and/or the gratification and / or the Program and/or any decision of Viacom18 / Channel, in any manner whatsoever.
44. The participating family(ies) / Selected Participating Family(ies) hereby agree and undertake that they shall not accept or undertake to accept or give or undertake to give, either directly or indirectly, any gifts, commission or other favor, of any kind whatsoever, to facilitate their selection / winning the Entry Process and / or the Program. Any knowledge of such an act shall lead to immediate disqualification of such the participating family(ies) / Selected Participating Family(ies) and Viacom18 / the Channel shall be entitled to take any and all action(s) against such Participants, as deemed fit by it.
45. Viacom18 / the Channel is not responsible for any errors or omissions in the terms and conditions contained herein. All information provided in the Entry Process / Program is provided “As is” without warranty of any kind. Viacom18 / the Channel makes no representations and disclaims all express, implied and statutory warranties of any kind to the viewers and/or any third party including, without limitation, warranties as to accuracy, timeliness, completeness, merchantability, or fitness for any particular purpose.
46. In case of any dispute or other matter arising in reference to the Entry Process and / or the Program and/or the gratification the Courts having jurisdiction to adjudicate the same shall exclusively be the courts at Mumbai, India.
47. In case of any dispute or difference in respect of this Entry Process and / or the Program, the decision of Viacom18 / the Channel shall be final and binding on all concerned.
